A new bill authored by State Rep. Troxclair in the Texas House seeks to improve the standards of care provided to sexual assault survivors in health care facilities, according to the Texas Legislature website.
The bill on Elections and Taxation category, introduced as HB 220 during the 89(2) legislative session on Monday, Aug. 18, was formally listed with the short title: ’Relating to the vote required by the governing body of a taxing unit to adopt an ad valorem tax rate that exceeds the voter-approval tax rate or authorize the issuance of tax bonds’.
The following is our breakdown, based on the actual bill text, and may include interpretation to clarify its provisions.
In essence, this bill amends the minimum standards of care provided to sexual assault survivors by health care facilities in Texas. It mandates that facilities offer a forensic medical examination, a private waiting area, access to an advocate, and necessary information formats. Survivors should be provided a private treatment room when available, and, depending on the contact history, access to prophylaxis for sexually transmitted infections. The bill also requires facilities to provide the contact details of the nearest sexual assault crisis center and a free shower after examination. With survivor consent and clinical indication, emergency contraceptives approved by the FDA must be offered. The act is set to take effect on Sept. 1, 2025.
Ellen Troxclair, a member of the House Committee on Delivery of Government Efficiency, proposed another six bills during the 89(2) legislative session. She is also a member of the House Committee on Ways & Means.
Bills in Texas go through a multi-step legislative process, including committee review, debates, and votes in both chambers before reaching a final decision. Each session, there are typically thousands of bills introduced, but only a portion successfully navigate the process to become law.
