U.S. Congressman Chip Roy has expressed his concerns about the policies of Bexar County District Attorney Joe D. Gonzales’s office, questioning whether their approach involves releasing dangerous criminals onto the streets. Congressman Roy’s concerns come after recent incidents in San Antonio involving repeat offenders who were released on bail. These incidents have sparked a debate about the city’s criminal justice practices.
In a letter dated August 31, 2023, Congressman Roy addressed District Attorney Gonzales, expressing deep concern about a recent incident where a repeat criminal, previously released on bail, injured three San Antonio Police Department (SAPD) officers. Congressman Roy believes that lax bail policies contribute to the safety threat faced by Bexar County residents and law enforcement personnel. He referenced an incident involving Jesse Garcia Jr., a career criminal, who engaged in a violent confrontation with SAPD officers after losing contact with his bail bondsman. The incident resulted in a four-hour standoff and the injury of two officers.
San Antonio Police Chief Bill McManus has also raised concerns about why individuals with extensive criminal records are allowed to return to the community. In his letter, Congressman Roy posed critical questions to District Attorney Gonzales and the broader leadership of San Antonio, seeking clarity on whether it is their preferred policy to release dangerous criminals onto the streets and whether these decisions align with the city’s leadership.
Congressman Roy demanded answers regarding prosecutors’ objections to low bond amounts or no bonds for certain defendants, updates to policies in light of recent incidents, the bond amount recommended in Jesse Garcia’s case, measures to prevent violent criminals from benefiting from lenient bond policies, collaboration between the district attorney’s office and county criminal judges to assess safety risks, and an explanation for why someone like Jesse Garcia Jr. was not confined given his extensive criminal record. He also inquired about the district attorney’s belief in Jesse Garcia Jr.’s rehabilitation before his release.
Congressman Roy emphasized the importance of public safety and urged the district attorney to clarify their intentions regarding bail policies before considering any future federal grants or resource requests. He expressed concern about the safety of law enforcement officers and the role of city leaders in exacerbating the situation, highlighting the potential harm and erosion of community trust in San Antonio and Bexar County’s safety.
